CITY OF CASSELBERRY <br />CODE ENFORCEMENT HEARING <br />JANUARY 19, 2023 <br />The City held its regular Code Enforcement hearing Thursday, January 19, 2023, at 6:30 p.m., in the City <br />of Casselberry Commission Chambers, 95 Triplet Lake Drive, Casselberry, Florida. Mr. Andrew W. Mai, <br />Special Magistrate, called the meeting to order at 6:30 p.m. <br />SPECIAL MAGISTRATE <br />Andrew W. Mai <br />CITY STAFF PRESENT <br />Micelania Acevedo, Senior Code Compliance Officer <br />Brenda Cutlip, Recording Secretary <br />Jen Nix, Assistant City Attorney <br />PLEDGE OF ALLIGIANCE <br />The Special Magistrate led the Pledge of Allegiance. <br />FORMAT FOR PROCEEDINGS <br />The Special Magistrate read the format for proceedings. <br />SWEARING IN OF THOSE IN ATTENDANCE <br />The Special Magistrate swore in those who would testify. <br />APPROVAL OF MINUTES <br />The Special Magistrate asked if anyone in the audience had any additions or corrections to the Minutes <br />from the December 15, 2022, hearing; there were none. The Special Magistrate approved the Minutes from <br />the December 15, 2022, hearing. <br />STATEMENT OF EVIDENCE <br />Supervisor Acevedo advised that all events occurred within the corporate limits of the City. The Officer's <br />notes, case narratives, testimony, photographs, supporting documents and PowerPoint presentation were all <br />entered as part of the official record. <br />SUBSEQUENT CASE- NOT IN COMPLIANCE- IMPOSE FINE <br />CE -22-000116 75 Concord Dr. <br />Supervisor Acevedo advised that CE -22-000116, 75 Concord Dr. was not in compliance by the date <br />previously set of November 14, 2022, by the Special Magistrate and the fine should be imposed. <br />A ruling was made by the Special Magistrate that case CE -22-000116, 75 Concord Dr. based on Code <br />Officer testimony, the Respondents did not comply by the order imposed on November 17, 2022. It was <br />ordered that the Respondents pay the City of Casselberry a fine in the amount of $225 per day and $25.00 <br />per day, capped at $250 for the business tax violation, for each day the violation exists and each day the <br />violation continues to exist past the date of compliance of January 19, 2023. The burden shall rest upon <br />the respondents to immediately notify the Code Compliance officer. <br />
