RESOLUTION 23-3554 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT <br />AGREEMENT WITH ANGELA BOATWRIGHT ON PARCEL ID: 34-21-30- <br />525-0000-2980 (2329 ANTILLES DRIVE); PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City owns public utilities located on Parcel ID: 34-21-30-525-0000-2980 <br />(2329 Antilles Drive) which are not currently within an approved utility easement; and <br />WHEREAS, the property owner, Angela Boatwright, has agreed to grant a utility easement <br />over a portion of the property for the necessary construction, installation, operation, maintenance, <br />and repair of public utilities; and <br />WHEREAS, Public Works & Utilities Department staff has reviewed the Utility Easement <br />Agreement with Angela Boatwright and finds it favorable to meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility <br />Easement Agreement with Angela Boatwright on Parcel ID: 34-21-30-525-0000-2980 (2329 <br />Antiiies Drive), attached lnereto, and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
