RESOLUTION 23-3569 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A COOPERATIVE AGREEMENT WITH THE <br />NATURAL RESOURCES CONSERVATION SERVICE FOR HOWELL <br />CREEK AND CARRIAGE HILL EROSION CONTROL DUE TO <br />HURRICANE IAN; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry experienced significant erosive damage within the <br />Gee Creek and Howell Creek drainage basins as a result of Hurricane Ian in September 2022; <br />and <br />WHEREAS, the City Commission authorized City staff to submit an application to the <br />United States Department of Agriculture Natural Resources Conservation Service (USDA <br />NRCS) in an effort to obtain a grant to help fund improvements needed to address the <br />aforementioned damage; and <br />WHEREAS, the USDA NRCS has agreed to award the City funding to assist with the <br />erosion control in Gee Creek basin (near Carriage Hill subdivision) and Howell Creek basin (at <br />Carmel by the Lake) via a Cooperative Agreement; and <br />WHEREAS, said Agreement provides for a total amount of financial assistance not to <br />exceed $362,418.75 ($319,781.25 for construction and $42,637.50 for technical assistance), and <br />a required 25% construction funding match (or $106,593.75) from the City; and <br />WHEREAS, City staff has reviewed the Cooperative Agreement submitted by the <br />USDA NRCS and finds it favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Cooperative Agreement with the United States Department of Agriculture Natural Resources <br />Conservation Service for Howell Creek and Carriage Hill erosion due to Hurricane Ian, attached <br />herewith, for a total federally funded amount not to exceed $362,418.75 and a local match of <br />$106,593.75, and authorizes the City Manager to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or pants of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
