City Council <br />December 18, 1989 <br />SPR -81-03 ( Continued) <br />MOTION: Mr. Henson moved, Mrs. Percle seconded, <br />and motion carried unanimously to approve <br />SPR -81-03 subject to all contingencies <br />which are en-umerated.n the <br />Barry Campbell memo dated December 14, <br />1989 with the exception of Contingency #2, <br />Boat Ramp Facilities (exempted by separate <br />Motion) ; further subject to the inclusion of <br />specific language recommended by the City <br />Attorney with reference to concurrency as <br />it relates to Chapter 163; approval of SPR - <br />81 -03 is contingent upon approval of The <br />Vinings (Phases II and III of Carmel -by -the - <br />Lake) ; further subject to the implementation <br />of the Escrow Agreement at closing in the <br />amount of $450,000 or by December 31, 1990 <br />and in the event the escrow fails, that which <br />is granted with reference to SPR -81-03 shall <br />immediately become null and void upon report <br />to the Escrow Agent; lastly subject to payment <br />of all costs germane to advertising and other <br />matters in accordance with ordinances and <br />resolutions of the City of Casselberry. <br />MOTION: Mr. Schutte moved, Mrs. Percle seconded, <br />and motion carried unanimously to amend <br />the Agenda moving Item III up as Item II. <br />II. Second Reading of Ordinance 651 - Amending Ordinance 233 (Carmel - <br />by -the -Lake Density <br />MOTION: Mr. Henson moved, Mrs. Percle seconded, <br />and motion carried unanimously to read <br />Public Notice relative to Ordinance 651. <br />Mrs. Garavano read notice as follows: <br />"Notice is hereby given by the City of Casselberry, Florida, <br />that the City Council will hold a Public Hearing to consider <br />enactment of Ordinance 651. This notice is given pursuant <br />to the provisions of Chapter 166 Florida Statutes and the <br />Charter and Ordinances of the City of Casselberry, Florida, <br />as amended and supplemented. Said Ordinance will be con- <br />sidered on first reading on Monday, December 4, 1989 and <br />the City Council will consider same for final passage and <br />adoption after the Public Hearing, which will be held in the <br />City Hall of Casselberry, Florida, on Monday, December 18, <br />1989 at 7:30 P.M., or as soon thereafter as possible. At <br />the meeting, interested parties may appear and heard with <br />respect to the proposed Ordinance. This hearing may be <br />(5) <br />
