Book 9911, Page 380, of the Public Records of <br />Seminole County, Florida, for the project known as Slovak Garden Planned Unit Development; <br />and <br />WHEREAS, the Developer as owner, has platted the property known as Grayson Square <br />which is recorded in Plat Book 87, Page 83, of the Public Records of Seminole County, Florida <br />(the "Property"); and <br />WHEREAS, pursuant to the development approvals, the Developer has completed the <br />construction of a lift station and related facilities, and installed a temporary generator, which is <br />located on the Property in an area more particularly described as follows: <br />Tract LS -1, Grayson Square, according to the plat thereof as recorded in <br />Plat Book 87, Page 83, Public Records of Seminole County, Florida. <br />(herein referred to as "Lift Station"); and <br />WHEREAS, the City and the Developer wish to set forth the general responsibility for <br />the repair and maintenance of the Lift Station. <br />NOW THEREFORE, in consideration of the mutual promises and covenants herein <br />contained, the City and the Developer agree as follows: <br />1. RECITALS. The foregoing recitals are hereby acknowledged to be true and <br />correct and are incorporated herein by reference. <br />2. Developer agrees to accept sole responsibility for the entire wastewater system at <br />the Property, including, but not limited to, fueling and maintaining the Lift Station and the <br />temporary generator as needed and in accordance with best practices, City Code, and state <br />regulations. <br />1 <br />
