<br />UTILITY MAINTENANCE AGREEMENT
<br />THIS UTILITY MAINTENANCE AGREEMENT entered into this 4-h day of
<br />4b+'`k a- , 2023, between PULTE HOME COMPANY, LLC, a Michigan limited liability
<br />company, 350 Peachtree Road Northeast, Suite 150, Atlanta, Georgia, 30326, herein referred to
<br />as "Developer" and the CITY OF CASSELBERRY, FLORIDA, a Florida municipal
<br />corporation, of 95 Triplet Lake Drive, Casselberry, FL 32707, herein referred to as "City".
<br />WHEREAS, the Developer and City entered in that certain Planned Unit Development
<br />Agreement recorded April 23, 2021, in O.R. Book 9911, Page 380, of the Public Records of
<br />Seminole County, Florida, for the project known as Slovak Garden Planned Unit Development;
<br />and
<br />WHEREAS, the Developer as owner, has platted the property known as Grayson Square
<br />which is recorded in Plat Book 87, Page 83, of the Public Records of Seminole County, Florida
<br />(the "Property"); and
<br />WHEREAS, pursuant to the development approvals, the Developer has completed the
<br />construction of a lift station and related facilities, and installed a temporary generator, which is
<br />located on the Property in an area more particularly described as follows:
<br />Tract LS -1, Grayson Square, according to the plat thereof as recorded in
<br />Plat Book 87, Page 83, Public Records of Seminole County, Florida.
<br />(herein referred to as "Lift Station"); and
<br />WHEREAS, the City and the Developer wish to set forth the general responsibility for
<br />the repair and maintenance of the Lift Station.
<br />NOW THEREFORE, in consideration of the mutual promises and covenants herein
<br />contained, the City and the Developer agree as follows:
<br />1. RECITALS. The foregoing recitals are hereby acknowledged to be true and
<br />correct and are incorporated herein by reference.
<br />2. Developer agrees to accept sole responsibility for the entire wastewater system at
<br />the Property, including, but not limited to, fueling and maintaining the Lift Station and the
<br />temporary generator as needed and in accordance with best practices, City Code, and state
<br />regulations.
