RESOLUTION 14-2571 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AN AGREEMENT WITH BRYANT MILLER OLIVE TO <br />UPDATE THE CASSELBERRY STREET LIGHTING ASSESSMENT <br />PROGRAM; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the Street Lighting Assessment Program adopted in 2009 has not been <br />updated since its initial adoption; and <br />WHEREAS, at its December 10, 2012 workshop meeting, the City Commission <br />reviewed a presentation on the Street Lighting Assessments and recommended updating the <br />assessment program; and <br />WHEREAS, the City of Casselberry requires outside counsel with expertise in the area of <br />special assessments; and <br />WHEREAS, the City of Casselberry received a proposal from special counsel, Bryant <br />Miller Olive, who has expertise in special assessments and has performed similar work; and <br />WHEREAS, the Bryant Miller Olive proposal includes the additional expertise of Burton <br />& Associates within their scope of services in preparing an assessment/methodology report required <br />to update the assessment; and <br />WHEREAS, the Bryant Miller Olive proposal is a responsive, responsible proposal in the <br />amount of $9,805 for legal services and $24,717 for the assessment/methodology report; and <br />WHEREAS, City staff has reviewed the proposal from Bryant Miller Olive and finds it <br />adequate to meet the requirements of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />proposal from Bryant Miller Olive and authorizes the Mayor to execute said document on behalf of <br />the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />
