RESOLUTION 15-2752 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, ESTABLISHING A CHARTER REVIEW <br />COMMITTEE; PROVIDING FOR QUALIFICATIONS FOR MEMBERSHIP OF <br />THE COMMITTEE; ESTABLISHING RESPONSIBILITIES AND REPORTING <br />REQUIREMENTS; PROVIDING FOR LEGAL AND STAFF ASSISTANCE TO <br />THE COMMITTEE; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE. <br />WHEREAS, Section 11.08 of the City Charter provides for a periodic review of the Charter by a <br />citizen review committee every seven years to make recommendations to the City Commission for possible <br />submission to the voters at the next regular election; and <br />WHEREAS, Section 11.08 of the City Charter also requires that said committee be appointed one <br />year before the next regular election cycle which will occur in August 2016; and <br />WHEREAS, the last Charter review was conducted in 2007-2008; and <br />WHEREAS, the City Commission deems it appropriate that a study and review of the existing City <br />Charter be conducted for the purpose of determining the advisability of amending any part or all of said <br />Charter except those parts not authorized to be amended by law; and <br />WHEREAS, the City Commission desires to provide an open, objective, and deliberative process <br />to provide ample opportunity for the public to participate in the City Charter amendment process. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, AS FOLLOWS: <br />SECTION I. Committee. A Charter Review Committee is hereby established, which shall be <br />composed of five (5) members to be appointed by the City Commission to serve for the duration of the <br />Committee as provided herein. Any vacancy which may occur shall be filled by the City Commission as <br />soon as practical. <br />SECTION II. Qualifications. Members of the Charter Review Committee shall be residents of <br />the City and shall remain City residents for the duration of their membership on the Committee. <br />SECTION II. Committee Responsibilities. The Committee shall have the responsibility of <br />reviewing the City's existing City Charter and providing written recommendations to the City Commission <br />for amendments to any part of said Charter except those parts not authorized to be amended by law. <br />SECTION III. Reporting Requirements. The Charter Review Committee's final report and <br />recommendations shall be presented to the City Commission no later than January 25, 2016. The City <br />Commission, upon receipt of the final report and recommendations of the Charter Review Committee, shall <br />review same and determine whether the existing Charter should be amended or revised. The City <br />Commission may cause to be prepared such Ordinance or Ordinances as it may deem advisable to amend or <br />revise the existing City Charter in the manner as provided by Chapter 166, Florida Statutes. <br />SECTION IV. Legal and Staff Assistance. The Charter Review Committee shall be provided <br />legal assistance by the City Attorney and staff assistance by the City Clerk's Office. The City Clerk and <br />the City Attorney shall facilitate the chatter review process. <br />
