RESOLUTION 23-3347 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 1 TO THE LOCAL <br />AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA <br />DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF <br />THE SUNSET DRIVE LIVABLE STREETS (FROM OXFORD ROAD TO <br />BUTTON ROAD) PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is committed to making its community safer, more <br />comfortable, and more connected for people of all ages and abilities to walk and bike; and <br />WHEREAS, in 2012 the City submitted an application to MetroPlan Orlando to request <br />funding for the Sunset Drive Livable Street Improvements Project (a.k.a. "Sunset Drive Livable <br />Streets (from Oxford Road to Button Road) Project"), which includes providing a shared use path, <br />narrowing of the travel lanes, driveway reconstruction, curb ramp reconstruction, signing and <br />pavement marking upgrades, improvements to Overbrook Drive, and on -street parking at Sunset <br />Park; and <br />WHEREAS, in 2016 as part of its adopted Multimodal Transportation Master Plan, the City <br />identified the aforementioned project as an unfunded need; and <br />WHEREAS, design and construction of the proposed improvements using federal funds <br />was programmed into the State of Florida Department of Transportation's (FDOT's) Work Program <br />for State Fiscal Year (FY) 2019-2020 and FY 2021-2022, respectively; and <br />WHEREAS, design of the project has been completed using federal funds; and <br />WHEREAS, in 2022 a Local Agency Program (LAP) Agreement between the City and <br />FDOT was executed in order to be able to construct the project using federal funds; and <br />WHEREAS, based on bid results, an additional $1,205,746 above the original LAP <br />Agreement is needed to construct the project; and <br />WHEREAS, Supplemental Agreement No. 1 to the aforementioned LAP Agreement <br />reflects an increased federal commitment in the amount of $914,000 to cover a portion of additional <br />cost; and <br />WHEREAS, Supplemental Agreement No. 1 to the aforementioned LAP Agreement <br />reflects an increased local commitment in the amount of $291,746 to cover the remainder of the <br />additional cost; and <br />WHEREAS, City staff has reviewed the aforementioned Supplemental Agreement No. 1 <br />and finds it acceptable to meet the needs of the City. <br />
