The proposed amendments to <br />Section 2-5.2, Purpose and hltent of Zoning Districts, provide consistency between the ULDR and the <br />changes proposed to the Comprehensive Plan in Ordinance 22-1572 which was a Comprehensive Plan text <br />amendment to change the allowable density and intensity within MTMU (Major Thoroughfare Mixed -Use) <br />and PMX-HIGH land use designations. Ordinance 22-1573 would be making subsequent changes in <br />Section 2-5.2 for the PMX-HIGH zoning district to increase density from 30 to 80 dwelling units per acre <br />and increasing the maximum floor area ratio (FAR) from 1.5 to 2.0 within the Code. The proposed changes <br />to Table 2-5.3, the land use table, include the addition of the following new land use types: mid -rise <br />dwellings with mixed uses, car washes, commercial kitchen, drive-through establishment, large retail <br />establishment, and microbrewery and micro -winery. The proposed amendments adjust the permitted and <br />conditional uses in Table 2-5.3 without taking away development rights of existing developments. <br />Additional proposed changes to Table 2-5.3 include removing redundances between land uses, updating <br />titles to match glossary definitions, and revising titles to more commonly used terms. Modifications were <br />also made to the footnotes related to pharmacies and storage yards. The proposed amendments to Table 2- <br />5.4, Size and Dimension Criteria, would modify the PMX-HIGH zoning district to increase the maximum <br />floor area ratio (FAR) from 1.5 to 2.0 and increase the maximum density to 80 dwelling units per acre. <br />These changes are consistent with the proposed amendments to the Comprehensive Plan provided in <br />Ordinance 22-1572. Section 5-21.2, Definition of Terms is proposed to be amended to add new definitions <br />for new land use types, and also existing land use types that did not previously have definitions. Two <br />modifications were made to ordinance 22-1573 between first and second reading. The definition of "micro - <br />brewery or micro -winery" in Section 5-21.2 was expanded to include limits on the amount of beer and wine <br />that may be produced per year at a facility. The effective date of Ordinance 22-1573 was also revised to <br />provide consistency with the effective date of Ordinance 22-1572 so the changes in Ordinance 22-1573 <br />would not go into effect before the changes in the Comprehensive Plan adopted with Ordinance 22-1572. <br />The Planning and Zoning Commission, acting as the City's Land Planning Agency (LPA), voted <br />unanimously at its meeting on August 10, 2022 to recommend approval of this item to the City Commission. <br />In response to a question from the City Commission, Ms. Hyson clarified that the reason for changing from <br />having two designations for restaurants, one with drive-through and one excluding drive-through was so <br />that a drive-through establishment could be expanded to include any type of use that has a drive-through. <br />She explained that staff had received inquiries regarding drive-throughs for businesses that were not <br />restaurants, so with the amendment, restaurant would be a land use only, and drive-through establishment <br />would be an add-on that would require conditional use approval and could be for any type of use that might <br />use a drive-through such as a pharmacy, drug store or grocery store. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended adoption of Ordinance 22-1573 on second and final <br />reading. <br />Public Hearing: Vice Mayor Aramendia stated this was a public hearing to hear and consider comments <br />and questions regarding Ordinance 22-1573. Vice Mayor Aramendia opened the floor for public <br />participation. No one came forward to address Ordinance 22-1573. Vice Mayor Aramendia closed the <br />public hearing relative to Ordinance 22-1573. <br />
