AGREEMENT FOR LAW ENFORCEMENT AGENCY USE OF SEMINOLE STATE COLLEGE PUBLIC SAFETY TRAINING COMPLEX GENEVA, FLORIDA, FISCAL YEAR 2022-2023 public law enforcement agencies, the College will accept either the payment or a purchase order prior to the commencement date of the agreement. b. All payments or for public law enforcement agencies purchase orders, are due at the time this agreement is signed by User. Notwithstanding the foregoing, this Agreement shall not be binding. upon the College until accepted approved and executed by the Vice President of Business Operations/Chief Financial Officer or designee College's submission of this Agreement for examination and signature by User does not constitute an offer to lease or a reservation or option for lease. In the event this Agreement is not so accepted approved and executed, User understands and agrees its recovery shall be strictly limited to the recovery of any pre -paid fees. c. The fees and specific details as needed for the use of College facilities are outlined in the attached Facilities Reservation form, and said form is hereby incorporated into this Agreement by this reference. 5. Term and Termination: a. This agreement shall commence on October 1, 2022, and shall be in effect until September 30, 2023, or be cancelled by either party upon written notice to the other party not less than 30 days prior to the termination date. 6. Acknowledgement: a. This agreement will not be binding upon the College until accepted, approved, and executed by the Vice President of Business Operations/Chief Financial Officer or designee. Accordingly, the undersigned acknowledges and agrees that the formation of this Agreement constitutes the making of a contract within the State of Florida and agrees to submit to the jurisdiction of the courts in the State of Florida with respect to claims arising out of this Agreement. Venue for any action arising hereunder shall be exclusively in Seminole County, Florida. b. It is understood that "Seminole State College" or "College" as used herein shall include the employees, licensees, invitees, agents, and the District Board of Trustees of Seminole State College. c. Public Safety Training Complex hours are 7:00 a.m.-6;00 p.m. Monday -Friday and 7:00 a.m.-5:00p.m. Saturday and Sunday. The facility will be closed when the College is closed to the public for business, including spring break, winter break, Fridays during the summer term and all other holidays that the College recognizes. d. User use of the Geneva facilities after normal operating hours listed above requires (i) prior written notice to (and written approval of) the College, and (ii) the continuous presence of a Seminole State College employee (who may be an adjunct employee), who is both present at the time of the usage and also representing the College as an employee, not as a member of User.
