AGREEMENT FOR <br />LAW ENFORCEMENT AGENCY USE OF <br />SEMINOLE STATE COLLEGE PUBLIC SAFETY TRAINING COMPLEX <br />GENEVA, FLORIDA, FISCAL YEAR 2022-2023 <br />public law enforcement agencies, the College will accept either the payment or a <br />purchase order prior to the commencement date of the agreement. <br />b. All payments or for public law enforcement agencies purchase orders, are due at <br />the time this agreement is signed by User. Notwithstanding the foregoing, this <br />Agreement shall not be binding. upon the College until accepted approved and <br />executed by the Vice President of Business Operations/Chief Financial Officer or <br />designee College's submission of this Agreement for examination and signature <br />by User does not constitute an offer to lease or a reservation or option for lease. In <br />the event this Agreement is not so accepted approved and executed, User <br />understands and agrees its recovery shall be strictly limited to the recovery of any <br />pre -paid fees. <br />c. The fees and specific details as needed for the use of College facilities are outlined <br />in the attached Facilities Reservation form, and said form is hereby incorporated <br />into this Agreement by this reference. <br />5. Term and Termination: <br />a. This agreement shall commence on October 1, 2022, and shall be in effect until <br />September 30, 2023, or be cancelled by either party upon written notice to the other <br />party not less than 30 days prior to the termination date. <br />6. Acknowledgement: <br />a. This agreement will not be binding upon the College until accepted, approved, and <br />executed by the Vice President of Business Operations/Chief Financial Officer or <br />designee. Accordingly, the undersigned acknowledges and agrees that the <br />formation of this Agreement constitutes the making of a contract within the State of <br />Florida and agrees to submit to the jurisdiction of the courts in the State of Florida <br />with respect to claims arising out of this Agreement. Venue for any action arising <br />hereunder shall be exclusively in Seminole County, Florida. <br />b. It is understood that "Seminole State College" or "College" as used herein shall <br />include the employees, licensees, invitees, agents, and the District Board of <br />Trustees of Seminole State College. <br />c. Public Safety Training Complex hours are 7:00 a.m.-6;00 p.m. Monday -Friday and <br />7:00 a.m.-5:00p.m. Saturday and Sunday. The facility will be closed when the <br />College is closed to the public for business, including spring break, winter break, <br />Fridays during the summer term and all other holidays that the College recognizes. <br />d. User use of the Geneva facilities after normal operating hours listed above <br />requires (i) prior written notice to (and written approval of) the College, and (ii) the <br />continuous presence of a Seminole State College employee (who may be an <br />adjunct employee), who is both present at the time of the usage and also <br />representing the College as an employee, not as a member of User.
