22-3342 MOU with City of Maitland for Wastewater Fee Collection

This is a Memorandum of Understanding (MOU) between the City of Maitland (Maitland) and the City of Casselberry Utilities Department (Casselberry) for the billing of wastewater services. The purpose of this MOU is to clearly identify the responsibilities of each party for the billing and collection of Wastewater payments by the Casselberry Utilities Department where the wastewater service is provided by Maitland and the water service is provided by Casselberry. By combining the water and wastewater charges on one bill, the customers will benefit from a unified bill. Maitland will benefit by reducing unpaid wastewater bills and Casselberry will benefit by the fee charged for the collection service. The term of this MOU will commence upon signature of the MOU by both parties. 1. Collection of Charges. Casselberry will collect all deposits and service charges due from Maitland's sewer service customers identified on Attachment A, which will be amended from time to time. Said charges will include current as well as past due charges, and will be collected on a monthly basis in accordance with policies and procedures adopted by Casselberry, attached as Attachment B. Casselberry reserves the right to unilaterally amend the policies in Attachment B, however Casselberry agrees to provide Maitland a copy of any amendments at least 30 days prior to the date of implementation. In the event of any conflict between the policies attached as Attachment B and this MOU, the terms of the MOU will control. 2. Water meters are owned and read by Casselberry. Maitland wastewater charges will be based on those reads. 3. Casselberry will use Maitland's current adopted wastewater rates, charges and usage caps for billing to the customers. 4. Casselberry Service Charge. In consideration of the services to be performed by Casselberry, Maitland agrees to pay Casselberry a service fee of $3 per monthly bill. The total monthly billing fee due to Casselberry will be deducted from the monthly payment Casselberry provides to Maitland for Maitland's wastewater service. Casselberry has the right to change the Service Charge upon written notice 60 days prior to the effective date of the increase. 5. Maitland Customer Lists/Rates/Deposits. Maitland will furnish to Casselberry a list of all customers to be billed by Casselberry together with the applicable billing rates. (The list to be updated from time to time.)
