RESOLUTION 22-3344 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING <br />EXECUTION OF A DEVELOPMENT AGREEMENT WITH CPI LAKE <br />KATHRYN ESTATES OWNER, L.L.C. FOR THE SUMMERLOCH <br />GREEN MOBILE HOME PARK, LOCATED AT 999 MANGO DRIVE, <br />CASSELBERRY, FLORIDA; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the Owner/Developer has operated the Mobile Home Park since before <br />January 1, 2020, and intends to continue operation of a Mobile Home Park on the Subject Property; <br />and <br />WHEREAS, Section 2-5.4. — Size and dimension criteria, of the City of Casselberry (City) <br />Unified Land Development Regulations (ULDR) states, in Footnote V. that "Mobile home parks <br />existing in the City of Casselberry as of January 1, 2020, will utilize the procedures provided in <br />Article III of the ULDR to rezone to RMHP and establish minimum lot area, minimum required <br />lot width, and setbacks;" and <br />WHEREAS, the Development Agreement attached as Attachment A is not a statutory <br />development agreement under Fla. Stat. 163.3220, et seq., but is authorized by the City's Home <br />Rule Power, the City Charter, and other controlling laws, and the City's police powers, and <br />followed the review and notice procedures provided in Article III as required by Footnote V in <br />Section 2-5.4 of the City's ULDR; and <br />WHEREAS, the City Commission finds that approving the development agreement will <br />not present a detriment to either the City of Casselberry, Florida, or the public. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Summerloch Green Mobile Home Park Development Agreement, attached as Attachment A, to <br />establish size and dimension criteria, as stated in Footnote V of Section 2-5.4 of the City's ULDR, <br />and authorizes the Mayor to execute said document on behalf of the City Commission. <br />SECTION II. CONFLICTS. All Resolutions or parts of Resolutions in conflict with <br />any of the provisions of this Resolution are hereby repealed. <br />SECTION III. SEVERABILITY. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. EFFECTIVE DATE. This Resolution shall become effective <br />immediately upon its passage and adoption. <br />
