CASSELBERRY CITY COMMISSION <br />Minutes of November 11, 2022 —Special Meeting <br />Page 2 of 3 <br />The City Clerk read Resolution 22-3341 by title only as follows: <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, RECOGNIZIN THE <br />DECLARATION OF A WEATHER EMERGENCY ISSUED BY THE GOVERNOR OF THE STATE <br />OF FLORIDA, EFFECTIVE THROUGHOUT THE STATE OF FLORIDA INCLUDING <br />SEMINOLE COUNTY AND THE MUNICIPALITIES SITUATED THEREIN, AND THE <br />DECLARATION OF A STATE OF EMERGENCY BY SEMINOLE COUNTY; CONFIRMING THE <br />LOCAL STATE OF EMERGENCY FOR THE CITY OF CASSELBERRY BY THE CITY <br />MANAGER; AUTHORIZING THE EXERCISE OF EMERGENCY MANAGEMENT <br />PROCEDURES IN ORDER TO PROTECT THE HEALTH, SAFETY, AND WELFARE OF THE <br />CITIZENS OF CASSELBERRY, MEMBERS OF THE GENERAL PUBLIC, AND CITY <br />EMPLOYEES; PROVIDING FOR AN EFFECTIVE DATE." <br />Staff Presentation: City Manager Randy Newlon stated Resolution 22-3341 confirms the City Manager's <br />Declaration of a State of Public Emergency due to imminent weather conditions associated with Hurricane <br />Nicole which was declared at 1:00 p.m. on November 9, 2022. Also being presented for consideration is <br />related Budget Amendment #23-016 which will provide funding for storm recovery operations in the amount <br />of $500,000. <br />Mr. Newlon then gave a brief presentation advising that on Wednesday, November 91'', with Tropical Nicole <br />(later Hurricane Nicole) approaching the State of Florida and threatening much of the peninsula, Governor <br />DeSantis had declared a State of Emergency for Seminole County, as well as many other counties in the state. <br />Seminole County had also declared a State of Emergency for the county, and Mr. Newlon as City Manager <br />had exercised his authority and declared a State of Emergency for the City of Casselberry at 1:00 p.m. on <br />Wednesday, November 91l'. City Code provides that although the City Manager has the authority to declare a <br />State of Emergency, the City Commission must affirm that declaration within 72 hours, and that was the <br />purpose for calling today's special meeting. Mr. Newlon further advised that he had not actually had to <br />exercise any emergency powers and did not at this time foresee a need to extend the Declaration of <br />Emergency any further, but there was a provision in the resolution for him to be able to do so if the need <br />arose, and that would have to be done by mid-day on Saturday, November 12t". <br />There is a related budget amendment in the amount of $500,000 for which approval is being requested which <br />is for storm -related expenses. This amount is half of what was established for Hurricane Ian but is being <br />requested in anticipation of any storm debris pickup and damage assessment that may be needed for this <br />storm. Mr. Newlon was not certain that the City would be approved by FEMA (Federal Emergency <br />Management Agency) for those kinds of expense recoveries, but the provision for advancing those costs if <br />necessary are provided by the resolution. He advised that the City had been approved for Category B cost <br />recoveries from Hurricane Nicole which includes costs to mobilize and take preventive measures from the <br />EOC (Emergency Operations Center), and everything associated with that. He then requested City <br />Commission consideration of Resolution 23-3341 to affirm the Declaration of Emergency and approval of <br />related Budget Amendment #23-016. <br />BA #23-016 <br />Explanation of Request: This budget amendment seeks City Commission approval to provide funding for <br />storm recovery operation for Hurricane Nicole in the amount of $500,000. <br />
