RESOLUTION 08-1960 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />ACCEPTANCE OF DRAINAGE EASEMENT(S) BETWEEN THE CITY OF <br />CASSELBERRY AND THE PROPERTY OWNERS OF FOUR RESIDENTIAL <br />PROPERTIES DIRECTLY AFFECTED BY THE GEE CREEK LANE EROSION <br />CONTROL PROJECT; NAMELY, LUIS A. BEDOYA AND YOLANDA L. BEDOYA, <br />JOSEPH C. FIORICA AND MICHAEL W. MORRIS AND MARY C. MORRIS <br />(TRUSTEES), RANDALL M. MANNING AND KARINA MANNING, AND DENNIS R. <br />MARKS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry has identified five (5) project areas in need of structural and non- <br />structural erosion control measures, which includes the Gee Creek Lane Erosion Control Project; and <br />WHEREAS, the erosion control measures within Gee Creek will alleviate the pervasive erosion experienced <br />within the project area directly adjacent to four separate residential properties; and <br />WHEREAS, the Public Works Department has obtained executed Drainage Easement instruments of <br />conveyance from the four residential property owners, which are required in order to construct the proposed <br />infrastructure improvements as part of the Gee Creek Lane Erosion Control Project; and <br />WHEREAS, acceptance of said Drainage Easement instruments are required in order for the City to <br />construct the project and receive reimbursement from the Natural Resources Conservation Service. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission of the City of Casselberry hereby approves the acceptance of four <br />separate Drainage Easement instruments of conveyance, (Attachments "A" — "D"), between the City of Casselberry <br />and (1) Luis A. Bedoya and Yolanda L. Bedoya, (2) Joseph C. Fiorica and Michael W. Morris and Mary C. Morris <br />(Trustees), (3) Randall M. Manning and Karina Manning, and (4) Dennis R. Marks. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br />SECTION III. Severability. if any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br />SECTION IV. Effective Date.
