RESOLUTION 08-1979 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A WARRANTY DEED CONVEYING CITY PROPERTY TO THE CASSELBERRY COMMUNITY REDEVELOPMENT AGENCY (CRA); PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, on June 13, 1997, the City purchased an out -parcel property at the corner of U.S. Highway 17-92 and Triplet Lake Drive from Casselberry Investment Properties, LTD.; and WHEREAS, funding for this acquisition was provided by the Casselberry Community Redevelopment Agency (CRA); and WHEREAS, the City holds title in Fee Simple via a Corporate Warranty Deed, (ORB 3256, PG 0419), for the vacant out -parcel; and WHEREAS, the CRA and City auditors have requested that the City convey this vacant out -parcel to the CRA via a Warranty Deed; and WHEREAS, a small area of the parcel was utilized for the Triplet Lake Drive Project roadway infrastructure improvements; and WHEREAS, the remainder parcel contains 14,389 square feet of area, or 0.33 acres, more or less. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves conveyance of said City out -parcel via a Warranty Deed instrument to the CRA, attached as Attachment "A", and authorizes the Mayor to execute said instrument on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this (.,�, day of #. , AD 2008. ATTEST: onna G.
