RESOLUTION 07-1845 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AMENDMENT VII TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND THE CITY OF ORLANDO REGARDING THE OPERATION OF THE IRON BRIDGE REGIONAL WATER RECLAMATION FACILITY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry and the City of Orlando entered into an Intergovernmental Agreement dated January 17, 1977 regarding participation in the regional wastewater treatment facility commonly know as the Iron Bridge Regional Water Reclamation Facility (Iron Bridge), and WHEREAS, an addendum to this agreement was executed on November 16, 1978, which established criteria for the development of user fees to be charged to each participating agency for the processing of wastewater at Iron Bridge, and WHEREAS, although the addendum expired on April 1, 2007, City staff and the City of Orlando agreed to extend the operation of Iron Bridge until a new agreement could be drafted, and WHEREAS, the City of Orlando has submitted Amendment VII to the original Interlocal Agreement which provides for a total treatment capacity of 3.3950 MGD for the City, (which equates to a 21% increase from the original capacity of 2.813 MGD and thus brings the City's proportionate share to 8.49%, down from the original 11.72%), and WHEREAS, City staff has reviewed Amendment VII to Interlocal Agreement with City of Orlando and found it to be adequate and favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Amendment VII of Interlocal Agreement with City of Orlando regarding the Iron Bridge Regional Water Reclamation Facility, (attached as "Exhibit A"), and authorizes the Mayor to execute said document (three originals) on behalf of the City. SECTION 11. The City Commission hereby accepts the terms and conditions as presented in said Agreement. SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
