ORDINANCE 22-1572 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN FUTURE LAND USE ELEMENT, TABLE FLU 1: LAND USE AND CORRESPONDING ZONING DISTRICTS FOR THE MAJOR THOROUGHFARE MIXED-USE LAND USE CATEGORY AND PLANNED MIXED-USE: HIGH RISE ZONING DESIGNATION AND POLICY FLU 1.5, IN ACCORDANCE WITH CHAPTER 163, FLORIDA STATUTES TO UPDATE BASED ON MARKET CONDITIONS; PROVIDING FOR VESTING OF LAND USES, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, Section 163.3167, Florida Statutes, requires the City of Casselberry (City) to maintain a comprehensive plan to guide its future development and growth; and WHEREAS, Section 163.3184, Florida Statutes, provides the process for the adoption of amendments to the City's Comprehensive Plan; and WHEREAS, to update the City's Comprehensive Plan in keeping with prevailing land use patterns, the City proposes amendments to the Future Land Use Element, in particular to Table FLU 1: Land Use and Corresponding Zoning Districts for the Major Thoroughfare Mixed -Use land use category and corresponding Planned Mixed -Use: High Rise zoning designation, as well as to Policy FLU 1.5, in accordance with Chapter 163, Florida Statutes; and WHEREAS, the proposed amendments to the Future Land Use Element are consistent with the City's Comprehensive Plan and State of Florida Growth Management Act; and WHEREAS, the Planning and Zoning Commission, as the City's Local Planning Agency, has held a public hearing with due public notice to consider this amendment to the City's Comprehensive Plan; and WHEREAS, a public hearing considering amendment of the City's Comprehensive Plan has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens were heard; and WHEREAS, words with underlined type shall constitute additions to the original text and strike thfough type shall constitute deletions to the original text, and asterisks (* * *) indicate that text shall remain unchanged from the language existing prior to adoption of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission does hereby adopt amendments to the Future Land Use Element, in particular to Table FLU 1: Land Use and Corresponding Zoning Districts for the Major Thoroughfare Mixed -Use land use category and Planned Mixed -Use: High Rise zoning designation and Policy FLU 1.5, in accordance with Chapter 163, Florida Statutes.
