RESOLUTION 22-3340 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />AGREEMENT FOR THE CONDITIONALLY TRANSFERRED EXCESS <br />PERSONAL PROPERTY OF THE DEPARTMENT OF DEFENSE <br />BETWEEN THE CITY OF CASSELBERRY AND THE STATE OF <br />FLORIDA AND THE STATE/UNITED STATES TERRITORY; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, in accordance with U.S. Code —Title 10. Armed Forces section 2576a, the <br />State of Florida and the State/United States (U.S.) Territory and the City of Casselberry are <br />authorized to enter into an agreement with respect to Department of Defense (DoD) excess <br />personal property conditionally transferred for law enforcement use; and <br />WHEREAS, the personal property is excess to the needs of the DoD and is determined <br />suitable to be used by law enforcement agencies whose primary function is the enforcement of <br />applicable federal, State, and local laws with preferences for use for counter-drug/counter- <br />terrorism, disaster -related emergency preparedness under such terms prescribed by the Secretary <br />of the DoD; and <br />WHEREAS, the City of Casselberry has determined that it is advantageous for the City <br />and its residents to contract with the State/U.S. Territory for the provision of the Law Enforcement <br />Support Office (LESO) Program State Plan of Operation (SPO), and to authorize the Chief of <br />Police to sign annual renewals of the contract. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA AS FOLLOWS: <br />SECTION I. The City Commission hereby approves the Addendum to the LESO Program <br />State Plan of Operation between the City of Casselberry and the State/United States (U.S.) <br />Territory, attached hereto, and authorizes the Chief of Police to execute said Agreement for and <br />on behalf of the City of Casselberry in relation to the Presidential Executive Order 14074 section <br />12, and to execute annual renewals of the Addendum. <br />SECTION II. Conflicts. All Resolutions of parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />
