ORDINANCE 22-1574 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL REGULATIONS, ARTICLE VII, GENERAL REGULATIONS, SECTION 2- 7.34, OXFORD PARK OVERLAY DISTRICT STANDARDS, TO PROVIDE FOR REGULATIONS THAT ARE CONSISTENT WITH DEVELOPMENT APPLICATIONS AND ECONOMIC DEVELOPMENT; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry ("City") maintains a Unified Land Development Regulations (ULDRs) that provide standards for the use and design of real property within the City; and WHEREAS, the ULDRs include the City's zoning ordinance, as well as special overlay district regulations; and WHEREAS, it is important to amend and keep current design standards to be consistent with existing and proposed development, as well as to update the standards for the benefit of the community's economic development activities; and WHEREAS, the City desires to amend Section 2-7.34, Oxford Park Overlay District Standards, to be consistent with proposed amendments to the ULDRs, and to establish consistency with development applications to use a consistent set of design standards; and WHEREAS, Large retail establishments should be allowed within the Oxford Park Overlay District, as they generally entail multiple uses on a single site, supporting internal trip capture, connectivity, and uniform design among the uses; and WHEREAS, words with underlined type shall constitute additions to the original text and strike through type shall constitute deletions to the original text, and asterisks (* * *) indicate that text shall remain unchanged from the language existing prior to adoption of this Ordinance; and WHEREAS, the City Commission of the City of Casselberry, hereby finds this Ordinance to be in the best interest of the citizens of Casselberry's public health, safety, and welfare. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. LEGISLATIVE FINDINGS. The above recitals are hereby adopted as the legislative findings of the City Commission. The City Commission finds and determines that there is competent substantial evidence to support the findings and determinations made in this Section.
