RESOLUTION 22-3341 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />RECOGNIZING THE DECLARATION OF A WEATHER EMERGENCY <br />ISSUED BY THE GOVERNOR OF THE STATE OF FLORIDA, <br />EFFECTIVE THROUGHOUT THE STATE OF FLORIDA INCLUDING <br />SEMINOLE COUNTY AND THE MUNICIPALITIES SITUATED <br />THEREIN, AND THE DECLARATION OF A STATE OF EMERGENCY <br />BY SEMINOLE COUNTY; CONFIRMING THE LOCAL STATE OF <br />EMERGENCY FOR THE CITY OF CASSELBERRY BY THE CITY <br />MANAGER; AUTHORIZING THE EXERCISE OF EMERGENCY <br />MANAGEMENT PROCEDURES IN ORDER TO PROTECT THE <br />HEALTH, SAFETY, AND WELFARE OF THE CITIZENS OF <br />CASSELBERRY, MEMBERS OF THE GENERAL PUBLIC, AND CITY <br />EMPLOYEES; PROVIDING FOR AN EFFECTIVE DATE, <br />WHEREAS, the weather system identified as Hurricane Nicole by the National <br />Hurricane Center posed a serious potential threat to the residents and property of the <br />City of Casselberry; and <br />WHEREAS, Hurricane Nicole had the potential for causing substantial damage to <br />public utilities, public buildings, public communication systems, public streets and roads, <br />public drainage systems, commercial and residential buildings and areas; and <br />WHEREAS, the Honorable Ron DeSantis, Governor of the State of Florida, has <br />entered, on November 7, 2022, the attached Executive Order Number 22-253 <br />establishing a state of emergency as a result of Hurricane Nicole, attached as Exhibit <br />A; and <br />WHEREAS, Seminole County extended their local state of emergency related <br />to Hurricane Ian, by Executive Order 2022-016 dated November 7, 2022; and <br />WHEREAS, the City of Casselberry desires to adequately protect its citizens <br />from the hazards of Hurricane Nicole and potential adverse situations and effects; <br />and <br />WHEREAS, the immediate danger to the public health, safety, or welfare <br />required emergency action; and <br />WHEREAS, Chapter 252, Florida Statutes, and Chapter 30 of the City Code, <br />empower the City Commission to declare a State of Local Emergency when <br />conditions such as those described above are found to exist; and <br />WHEREAS, Chapter 252, Florida Statutes, and Chapter 30 of the City Code, <br />empower the City Manager, as Director of Emergency Management, to exercise <br />extraordinary powers during the existence of a State of Local Emergency, including <br />the exercise of certain powers by emergency regulations issued by the City <br />1 <br />
