EXECUTIVE ORDER NO. 2022- 0/ 6 <br />SEMINOLE COUNTY, FLORIDA <br />EXECUTIVE ORDER EXTENDINGTHE DECLARED LOCAL STATE OF EMERGENCY <br />(Hurricane Ian and Subtropical Storm Nicole) <br />WHEREAS, pursuant to Chapter 252, Florida Statutes, constitutional home rule powers, Chapter 72, <br />Seminole County Code, the Seminole County Board of County Commissioners has adopted the Seminole County <br />revised Comprehensive Emergency Management Plan; and <br />WHEREAS, on September 23, 2022, Executive Order 2022-001 was executed, declaring a Local State of <br />Emergency under the provisions of Chapter 72, Seminole County Code, due to the severe weather; very high winds; <br />heavy rain; threat of tornadoes and serious flooding posed by Hurricane Ian; and <br />WHEREAS, on September 29, 2022 and every seven (7) days thereafter, the Local State of Emergency was <br />extended for an additional seven (7) days as reflected in Executive Orders 2022-005, 2022-008, 2022-010, 2022-011, <br />2022-13, and 2022-014 due to the severe flooding and remediation of hazardous debris caused by Hurricane Ian; and <br />WHEREAS, the Governor of the State of Florida has issued Executive Order No, 2022-219 declaring a State <br />of Emergency in all Florida Counties due to Hurricane Ian; and <br />WHEREAS, Subtropical Storm Nicole has developed in the Caribbean and is expected to cause a prolonged <br />period of hazardous weather and Hurricane conditions in portions of state, including Seminole County; and <br />WHEREAS, the remediation efforts from Hurricane Ian, such as debris removal, flood remediation, and <br />repairs to utilities and other infrastructure, continue to pose a serious threat to the health, safety, and welfare of the <br />residents of Seminole County; and <br />WHEREAS, the Federal Emergency Management Agency ("FEMA") has started providing Temporary <br />Housing Units to residents that have sustained extensive flooding to their home by Hurricane Ian; and <br />WHEREAS, Section 252.38(3)(a)(5), Florida Statutes, provides authority for counties to declare a Local <br />State of Emergency. <br />NOW, THEREFORE, BY THE AUTHORITY VESTED IN ME, IT IS HEREBY ORDERED THAT: <br />Section 1. Extension of Declared Local State of Emergency. Due to the damage caused by severe <br />weather; extensive debris; very high winds; heavy rain; tornadoes and flooding caused by Hurricane Ian; all of which <br />pose a serious threat to the lives or property of the residents of Seminole County, an extension to the Declared Local <br />State of Emergency is effective immediately. The Local State of Emergency will remain in effect within the legal <br />boundaries of Seminole County, Florida for seven (7) days from the date hereof and may be extended by Executive <br />Order as necessary in seven (7) day increments. <br />Section 2. Waiver of Procedures and Formalities Otherwise Required. Due to the extension of <br />the Local State of Emergency, the procedures and formalities required of the County by law or ordinance continue to <br />be waived as they pertain to: <br />(a) Performance of public work and taking whatever prudent action is necessary to <br />ensure the health, safety and welfare of the community; <br />(b) Entering into contracts; <br />(c) Incurring obligations; <br />(d) Employment of permanent and temporary workers; <br />(e) Utilization of volunteer workers; <br />(f) Rental of equipment; <br />(g) Acquisition and distribution, with or without compensation, of supplies, materials <br />and facilities; <br />(h) Appropriation and expenditure of public fiinds; and <br />(i) Placement of Temporary Housing Units. <br />Section 3. Alterations or Rescission.
