ORDINANCE 21-1560 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO BUILDING PERMIT FEES, AMENDING THE CODE OF ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER I, GENERAL ADMINISTRATION, ARTICLE IV, BUILDING CODE, SECTION 1-4.3, BUILDING PERMITS, SECTION 1-4.3(D), SCHEDULE OF BUILDING PERMIT FEES, UPDATING BUILDING SAFETY FEES AND INCLUDING ADDRESSING FEES TO IMPLEMENT THE FLORIDA BUILDING CODE, PER S. 553.80, OF THE FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry is an incorporated municipality within the State of Florida and, per Florida Statute (s.) 553.80, each local government shall regulate building construction and each State agency shall enforce the Florida Building Code on all public or private buildings, structures, and facilities; and WHEREAS, the basis for a fee structure for allowable activities shall relate to the levels of service provided by the City of Casselberry and shall include consideration for refunding fees, due to services not optioned, based on services provided as prescribed by s. 553.791, but not provided for by the City of Casselberry. Any fees charged shall be consistently applied; and WHEREAS, through this Ordinance, the City of Casselberry proposes to amend Section 1-4.3(D), Schedule of building permit fees, listed in of the Unified Land Development Regulations of the City's Code of Ordinances, in keeping with Florida Statute s. 553.80 and s. 166.222; and WHEREAS, per s. 553.80, the City of Casselberry shall update its building permit and inspection process before amending the fee schedule, which it has done by adding a Building Official and a new private provider, updated applications, and purchased additional permitting software. The City of Casselberry also conducted a review of current fees and is proposing updated fees within this Ordinance, in keeping with the State law process; and WHEREAS, words with double -underlined type shall constitute additions to the original text and strike through type shall constitute deletions to the original text, and asterisks (* * *) indicate that text shall remain unchanged from the language existing prior to adoption of this Ordinance; and WHEREAS, the City Commission of the City of Casselberry, hereby finds this Ordinance to be in the best interest of the citizens of Casselberry's public health, safety, and welfare.
