RESOLUTION 07-1799 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING (MOU) <br />BETWEEN THE CITY OF CASSELBERRY AND THE FLORIDA DEPARTMENT <br />OF TRANSPORTATION (FDOT) FOR THE US HIGHWAY 17-92 AND SR 436 <br />INTERSECTION MAST ARM SIGNALIZATION UPGRADES; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry wishes to improve the aesthetics of the major roadway <br />intersections located within the City; and <br />WHEREAS, FDOT is currently completing the engineering/design phase for interchange <br />improvements at the intersection of US Highway 17-92 and SR 436, which include standard FDOT Mast <br />Arm Signalization; and <br />WHEREAS, the City desires to upgrade from the standard FDOT Mast Arm Signalization to <br />enhanced Decorative Mast Arm Signalization in an effort to align with the City's vision; and <br />WHEREAS, FDOT has submitted a Memorandum of Understanding recognizing that the City will <br />pay the cost difference associated with constructing the Decorative Mast Arm Signalization upgrades as <br />compared to the standard FDOT Mast Arm Signalization; and <br />WHEREAS, City staff and the City Attorney have reviewed the MOU submitted by FDOT and find <br />it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the MOU submitted <br />by FDOT, (attached as "Exhibit N'), and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions <br />of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Resolution. <br />SECTION IV. Effective Date.
