RESOLUTION 10-2128 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING THE EXECUTION OF A STATE HIGHWAY MAINTENANCE MEMORANDUM OF AGREEMENT CONTRACT NO.: APT00 BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, for over ten years, as per an existing MOA agreement between the City of Casselberry and FDOT, the City of Casselberry has maintained the beautification and routine right- of-way maintenance elements of U.S. Highway 17-92, (Seminola Boulevard to the South City Limits), and S.R. 436, (Anchor Road to Howell Branch Road); and WHEREAS, per the existing MOA agreement, FDOT has provided financial compensation to the City for said right-of-way maintenance services; and WHEREAS, the existing MOA agreement for said right-of-way maintenance services will expire on May 1, 2010; and WHEREAS, the City of Casselberry wishes to continue an active role in beautification and maintenance of said right-of-ways; and WHEREAS, FDOT has submitted a new Highway Maintenance Memorandum of Agreement (MOA) for these two roadway right-of-ways in the reimbursable amount of $70,000 per year for three (3) consecutive years for a total amount of $210,000.00; and WHEREAS, Public Works has reviewed the proposed FDOT Highway Maintenance Memorandum of Agreement Contract No.: APT00 between the City of Casselberry and FDOT and finds it favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Highway Maintenance Memorandum of Agreement between the Florida Department of Transportation and the City of Casselberry; District Contract Job Number APT00, State Job Number 244549-1-78-01, (attached as Attachment "A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. The City Commission hereby accepts the terms and conditions as presented in said Agreement.
