RESOLUTION 09-2004 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN EMERALD UTILITIES & SITE DEVELOPMENT, INC. AND THE CITY OF CASSELBERRY FOR THE CONSTRUCTION OF THE ANCHOR ROAD IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the Anchor Road Improvements Project is a joint City -County project that includes multiple funding sources, including City funds, Seminole County funds, and federal Community Development Block Grant (CDBG) funds; and WHEREAS, this project will provide for improved utilities, drainage improvements, and new sidewalks for the Anchor Road corridor; and WHEREAS, the City of Casselberry advertised for bids in the Orlando Sentinel on Sunday, December 21 & 28, 2008 and Sunday, January 4, 2009 for the Anchor Road project; and WHEREAS, on January 23, 2009, the City received eight (8) sealed bids; and WHEREAS, of the bids received and evaluated, Emerald Utilities & Site Development, Inc. (Emerald) provided the lowest, qualified bid in the amount of $1, 907,400 for Phase 1 and Phase 2 of the project, exclusive of bid alternative items; and WHEREAS, Emerald has satisfactorily performed similar work; and WHEREAS, staff highly recommends a five percent contingency, which will bring the total construction budget to $2,002,770; and WHEREAS, funding for construction has been budgeted and is available through the Water and Sewer Utilities Fund, CDBG funds, and County funds via a previously executed Interlocal Agreement; and WHEREAS, City staff have reviewed the bid proposal from Emerald and found it to be the lowest responsive, responsible, and adequate bid proposal to meet the project requirements of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMSSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement with Emerald Utilities & Site Development, Inc. (attached as "Exhibit A"), and authorizes the Mayor to execute said documents on behalf of the City. SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
