RESOLUTION 14-2678 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO A PLANNED UNIT DEVELOPMENT AGREEMENT WITH THE ALLEGRO AT CASSELBERRY, L.L.C.; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, The Allegro at Casselberry, LLC (Allegro) wishes to construct a nursing home (assisted living facility) consisting of 85 dwelling units and 84 suites (combined 229 beds) on the property located northeasterly of the intersection of IIowell Branch Road and Lake Ann Lane; and WHEREAS, the City and Allegro desire to recognize a mutual obligation for the planning, development, and use of the property; and WHEREAS, a Planned Unit Development Agreement provides in detail the mutual obligations voluntarily entered into by each party; and WHEREAS, the City Commission agrees that this Planned Unit Development Agreement is a sound development plan that will accomplish the goals of the City of Casselberry. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Casselberry, Florida: SECTION I. The City Commission hereby accepts the terms and conditions as presented in the "Planned Unit Development Agreement," and authorizes the Mayor to execute said document, attached as "Attachment A" and made a part hereof. SECTION II. CONFLICTS. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. SEVERABILITY. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
