RESOLUTION 15-2722 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF CHANGE ORDER NO. 1 TO THE AGREEMENT WITH <br />THE MIDDLESEX CORPORATION FOR THE CASSEBERRY ROAD <br />REHABILITATION AREA 4-7 PROJECT; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, as part of is Neighborhood Improvement Program the City of Casselberry <br />has set aside funds for Citywide road rehabilitation; and <br />WHEREAS, on June 4, 2014, as the result of a competitive bid process, the City of <br />Casselberry awarded The Middlesex Corporation a contract in the amount of $1,535,583.15 to <br />complete road rehabilitation work in Neighborhood Improvement Program Areas 4-7; and <br />WHEREAS, The Middlesex Corporation has completed construction of the project and <br />Change Order No.I represents the close out of the project inclusive of over run and under run of the <br />estimated bid quantities for road rehabilitation work in Areas 4-7 and represents a true up of the <br />contract based on the unit prices in the original bid for Areas 4-7; and <br />WHEREAS, City staff has reviewed Change Order No. 1 for The Middlesex Corporation <br />in the amount of $41,485.48 and finds it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves Change <br />Order No. 1 to the Agreement with The Middlesex Corporation and authorizes the Mayor to <br />execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
