RESOLUTION 15-2708 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA APPROVING AND AUTHORIZING THE <br />FIRST AMENDMENT TO THE FUNDING AND PROGRAM <br />AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF <br />ECONOMIC OPPORTUNITY FOR FUNDING OF THE STATE ROAD <br />436 AND RED BUG LAKE ROAD SMALL AREA STUDY; PROVIDING <br />FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry's Comprehensive Plan Future Land Use Element <br />Policy 10.2, Small Area Studies, states, "Publicly or privately sponsored Small Area Studies <br />shall be conducted to identify strategies for physically and functionally redeveloping areas into a <br />mixture of land uses with the intent of making these areas more economically viable and <br />livable"; and <br />WHEREAS, the 2014 Legislature appropriated recurring funds from the Grants and <br />Donations Trust Fund for the purpose of providing technical assistance to local governments for <br />implementation of growth management planning efforts; and <br />WHEREAS, staff prepared and submitted a scope of services to develop a small area <br />land use, parking and mobility study for an area generally located adjacent to the intersection of <br />State Road 436 and Red Bug Lake Road; and <br />WHEREAS, a grant to fund such study in the amount of $25,000 was awarded to the <br />City by the Florida Department of Economic Opportunity (FDEO); and <br />WHEREAS, a Funding and Program Agreement with the FDEO was approved by the <br />City Commission on October 13, 2014 via Resolution 14-2665 and executed; and <br />WHEREAS, a fully executed copy of the Funding and Program Agreement from the <br />FDEO was received on January 12, 2015 and the consultant for the study was issued a notice to <br />proceed on January 13, 2015; and <br />WHEREAS, the delay in commencing the study has necessitated an adjustment to the <br />deliverable due dates for the scope of services outlined in the Funding and Program Agreement, <br />and are provided in the First Amendment to the Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the First <br />Amendment to the Funding and Program Agreement with the State of Florida Department of <br />Economic Opportunity and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />
