ORDINANCE NO. 98-918 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING ORDINANCE NO. 95-852 (WHICH ORDINANCE <br />ESTABLISHED THE COMMUNITY REDEVELOPMENT TRUST FUND <br />FOR THE CITY OF CASSELBERRY COMMUNITY REDEVELOPMENT <br />AGENCY) TO PROVIDE THAT SEVENTY PERCENT (70%) OF THE <br />INCREMENT REVENUES DERIVED BY SEMINOLE COUNTY FOR <br />THOSE PROPERTIES LOCATED IN THE CASSELBERRY COMMUNITY <br />REDEVELOPMENT AREA SHALL BE DEPOSITED IN THE <br />CASSELBERRY COMMUNITY REDEVELOPMENT TRUST FUND <br />THROUGH THE EXISTING TERM OF THE CASSELBERRY <br />REDEVELOPMENT PLAN; DELETING THE SAVINGS CLAUSE; <br />PROVIDING FOR CONTINGENT FUTURE TRANSFERS; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, CODIFICATION AND EFFECTIVE <br />DATE. <br />WHEREAS, under Section 163.410, Florida Statutes, the powers conferred by the <br />Community Redevelopment Act of 1969 are to be exercised exclusively by the governing body of a <br />home rule charter county unless the governing body of such county, by resolution, specifically <br />delegates the exercise of such powers within the corporate boundaries of a municipality to the <br />governing body of such municipality; and <br />WHEREAS, because Seminole County has adopted a home rule charter, it is necessary for <br />the City of Casselberry, Florida, to obtain a delegation of the powers, through resolution, conferred <br />upon Seminole County by the Community Redevelopment Act of 1969 so that the City may exercise <br />the authority and privileges conferred by such Act within the City's Community Redevelopment Area, <br />and <br />WHEREAS, Section 163.410, Florida Statutes (1993), permits such a delegation to be made <br />subject to such conditions and limitations as Seminole County may impose; and <br />WHEREAS, the Seminole County Board of County Commissioners has, by Resolution No. <br />95-R-255 dated November 14, 1995, delegated to the City of Casselberry the right and authorization <br />
