RESOLUTION 16-2874 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION AND CONVEYANCE OF AN EASEMENT TO DUKE ENERGY FOR ACCESS TO SWITCHGEAR FACILITIES AND DECORATIVE STREET LIGHTS RELATED TO THE EXPANSION OF THE LAKE CONCORD PARK PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City has entered into construction infrastructure agreements with Duke Energy to construct and install street lighting infrastructure improvements for the realignment/reconstruction of Triplet Lake Drive and the expansion of Lake Concord Park into the residential/commercial area located south of City Hall; and WHEREAS, Duke Energy requires the conveyance of an easement from the City on Parcel ID #08-21-30-5TW-0000-0030 to provide Duke Energy and/or their agents access to switchgear facilities and decorative street lights located within the Lake Concord Park expansion; and WHEREAS, the Public Works staff has reviewed the proposed easement to be conveyed to Duke Energy and finds it favorable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the execution and conveyance of an easement on Parcel ID 408-21-30-5TW-0000-0030 to Duke Energy (attached as Exhibit A) for access to switchgear facilities and decorative street lights related to the expansion of Lake Concord Park and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this — Q� day of , AD 2016.
