Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />July 13, 2022 <br />Page 2 <br />Fifth Item of Business: CU 22-08: 232-234 SR 436. A conditional use request for a Package Liquor Store <br />(3PS) located at 232-234 SR 436. <br />Ms. Antonia DeJesus, Planner II, reviewed the information provided in her memorandum dated July 13, <br />2022 to the City of Casselberry Planning and Zoning Commission. Ms. DeJesus said staff recommends that case <br />number CU 22-08 be approved with staffs conditions, based upon the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is <br />consistent with the Comprehensive Plan as per the written findings contained within the staff report. The conditions <br />of approval are as follows: <br />The conditional use shall be limited to the location of 232-234 SR 436. <br />All sales of alcoholic beverages shall be for only off-site consumption. Consumption of alcoholic <br />beverages on-site is prohibited. <br />The hours of sales shall comply with the operation and closing procedures outlined in Section 10-2 and <br />Section 10-3 of the City of Casselberry's Code of Ordinances. <br />Any interior or exterior alterations, including signage, shall be properly permitted through the City's <br />Building Division to ensure compliance with the Florida Building Code and Fire Prevention Code. <br />The business shall comply and remain in compliance with all City, County, and State requirements. <br />There shall be no outside display or storage of goods, materials, services, or vehicles. <br />The conditional use shall commence within 180 days of the approval. <br />The conditional use shall expire if the use is discontinued for more than 90 days. <br />All of the above conditions shall be fully and faithfully executed, or the conditional use shall become null <br />and void. <br />Mr. Hale asked the applicant to come forward. Mr. Douglas Markovitz, 130 State Road 436, Casselberry, <br />Florida came forward. In response to the Commission's question, Mr. Markovitz said he could commence business <br />within the 180 -day timeframe in condition number 7. Ms. DeJesus explained that if the applicant needed additional <br />time, there is a process to extend the conditional use timeframe. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Hale asked for a motion to address CU 22-08. Ms. Saporito made a motion that the Planning and <br />Zoning Commission approve case number CU 22-08 with staff's conditions, based upon the staff report and the <br />testimony and evidence presented, that the request meets the applicable provisions of the Unified Land Development <br />Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff <br />
