Planning & Zoning Commission/ Local Planning Agency Minutes July 13, 2022 Page 2 Fifth Item of Business: CU 22-08: 232-234 SR 436. A conditional use request for a Package Liquor Store (3PS) located at 232-234 SR 436. Ms. Antonia DeJesus, Planner II, reviewed the information provided in her memorandum dated July 13, 2022 to the City of Casselberry Planning and Zoning Commission. Ms. DeJesus said staff recommends that case number CU 22-08 be approved with staffs conditions, based upon the staff report and the testimony and evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. The conditions of approval are as follows: The conditional use shall be limited to the location of 232-234 SR 436. All sales of alcoholic beverages shall be for only off-site consumption. Consumption of alcoholic beverages on-site is prohibited. The hours of sales shall comply with the operation and closing procedures outlined in Section 10-2 and Section 10-3 of the City of Casselberry's Code of Ordinances. Any interior or exterior alterations, including signage, shall be properly permitted through the City's Building Division to ensure compliance with the Florida Building Code and Fire Prevention Code. The business shall comply and remain in compliance with all City, County, and State requirements. There shall be no outside display or storage of goods, materials, services, or vehicles. The conditional use shall commence within 180 days of the approval. The conditional use shall expire if the use is discontinued for more than 90 days. All of the above conditions shall be fully and faithfully executed, or the conditional use shall become null and void. Mr. Hale asked the applicant to come forward. Mr. Douglas Markovitz, 130 State Road 436, Casselberry, Florida came forward. In response to the Commission's question, Mr. Markovitz said he could commence business within the 180 -day timeframe in condition number 7. Ms. DeJesus explained that if the applicant needed additional time, there is a process to extend the conditional use timeframe. Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Hale asked for a motion to address CU 22-08. Ms. Saporito made a motion that the Planning and Zoning Commission approve case number CU 22-08 with staff's conditions, based upon the staff report and the testimony and evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff
