RESOLUTION 18-3023 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE ESTABLISHED VESTED RIGHTS PROCEDURES FOR <br />VESTING FROM EDUCATIONAL SYSTEM IMPACT FEES UNDER <br />SEMINOLE COUNTY ORDINANCE 2018-1; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, Seminole County adopted Ordinance 2018-1, which went into effect on April <br />10, 2018, and raised educational system impact fees county -wide; and <br />WHEREAS, the ordinance provides that, before the effective date, the County and the cities <br />may enter into written vested rights agreements with property owners which will permit a property <br />owner to pay only the former, lower educational system impact fee rates rather than the new, higher <br />rates; and <br />WHEREAS, Seminole County adopted Ordinance 2018-13; which amended Ordinance <br />2018-1, and had an effective date of April 17, 2018; and <br />WHEREAS, the City desires to modify its Resolution 18-3013 to allow the City Manager to <br />approve and sign Vested Rights Agreements for the City, and to recognize the extension of the <br />deadline for agreements due to the County's amendment to Ordinance 2018-1; and <br />WHEREAS, the County Ordinance provides that the City's vested rights agreements will be <br />binding on the County. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Subsection 2 of Section 1 of Resolution 18-3013 is amended as follows: <br />(2) Process. The applications should be submitted to the City Manager who will <br />determine, in conjunction with the Community Development Department, whether the application <br />meets the requirements of this Resolution. The City Manager shall complete the initial application <br />review within five (5) business days of receipt of a complete application. If the City Manager <br />determines the application meets the requirements of this Resolution, the City Manager shall approve <br />and sign the Vesting Agreement. The City Commission hereby ratifies agreements signed by the City <br />Manager prior to the date of this Resolution. <br />(3) Deadline for Application. All applications must be received no later than April 10, <br />2018. <br />(4) Revocation. Building permits for all or part of the project must be issued within 18 <br />months from the date of a Vesting Agreement, or the Vesting Agreement will be revoked.
