I ll..1.'i f ii: l,1..34'il''�. <br />IERK `i v ?{ i.{ -056469 <br />DEVELOPMENT COMMITMENT AND VESTED RIGHTS AGREEMENT <br />PERTAINING TO EDUCATIONAL SYSTEM IMPACT FEES ONLY <br />THIS DEVELOPMENT COMMITMENT AND VESTED RIGHTS AGREEMENT <br />PERTAINING TO EDUCATIONAL SYSTEM IMPACT FEES ONLY (this "Agreement") is <br />made and entered into this ''I' day of iapo, t , 2018, by and between the CITY <br />OF CASSELBERRY, a municipal corporation organized and existing under the laws of the State <br />of Florida, whose address is 95 Triplet Lake Drive, Casselberry, FL 32707, (the "City"), and <br />CONCORD DEVELOPMENT PARTNERS, LLC ("Owner"). <br />RECITALS: <br />WHEREAS, Owners holds the fee simple title in and to those certain parcels of real <br />property described in Exhibit "A", attached hereto and made a part hereof by this reference (the <br />"Property"); and a map depiction of the property in Exhibit "B"; and <br />WHEREAS, beginning in October of 2017, Owner entered into an agreement for purchase <br />of "Property" understanding the zoning on the property allows 21 residential units; and <br />WHEREAS, shortly after signing agreement to purchase property, the Owner moved <br />forward to hire an engineering firm and an architecture firm; and <br />WHEREAS, on January 5, 2018, the Owner closed on the property and became the fee <br />simple owner; and <br />WHEREAS, the Owner, engineer and architect firms held a pre -application meeting with <br />City Staff on February 7, 2018; and <br />WHEREAS, the Owner hired Stephen Ratcliff on February 10, 2018 to assist in moving the <br />project forward through the development review process; and <br />WHEREAS, the Owner and engineer, architect and Mr. Ratcliff met again on March 13, <br />2018 to discuss the project in more detail, including layout designs, architecture features and buffer <br />yard requirements; and <br />WHEREAS, Owner submitted the Development Commitment and Vested Rights <br />Agreement Pertaining to Educational System Impact Fees Only to the City on March 19, 2018; and <br />0215049\ 178377\5801067v5 <br />
