<br />THIS DRAINAGE EASEMENT is made and entered this day of— III Clk , 2018,
<br />by GLEN V. RASH, a single person, whose address is 205 Plaza Oval, Casselberry, FI,6rida 32707,
<br />hereinafter referred to as the Grantor, and CITY OF CASSELBERRY, a Florida municipal
<br />corporation, whose address is 95 Triplet Lake Drive, Casselberry, Florida 32707, hereinafter
<br />referred to as the Grantee;
<br />WITNESSETH:
<br />WHEREAS, Grantor is the owner of that certain real property located in Casselberry, Seminole
<br />County, Florida, more particularly described as set forth on Exhibit "A" attached hereto and
<br />incorporated herein by this reference (the "Property"); and
<br />WHEREAS, Grantor desires to grant and convey unto Grantee an non-exclusive, perpetual,
<br />permanent easement and right-of-way for drainage purposes with full authority to enter upon,
<br />desiltrate, sump, excavate, construct, and maintain, as the GRANTEE and its assigns may deem
<br />necessary, a drainage system consisting of pipes, detention, percolation or disposal areas or
<br />combination thereof, together with appurtenant drainage structures, over, under, upon and through
<br />that certain portion of the Property which is described on Exhibit "B" attached hereto (hereinafter
<br />referred to as the "Easement Area").
<br />NOW, THEREFORE, for and in consideration of the mutual covenants and agreements contained
<br />herein and other good and valuable consideration, the receipt and sufficiency of which are hereby
<br />acknowledged, Grantor and Grantee hereby agree as follows:
<br />Recitals. The foregoing recitals are true and correct and are incorporated herein by
<br />this reference.
<br />2. Grant of Easement by Grantor. Grantor does hereby create, grant, convey and declare
<br />to exist a non-exclusive, perpetual, permanent easement and right-of-way for drainage purposes with full
<br />authority to enter upon, desiltrate, sump, excavate, construct, and maintain, as the GRANTEE and its
<br />assigns may deem necessary, a drainage system consisting of pipes, detention, percolation or disposal
<br />areas or combination thereof, together with appurtenant drainage structures, over, under, upon and
<br />through the Easement Area.
