RESOLUTION 22-3327 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPOINTING AND AUTHORIZING AN <br />AGREEMENT WITH ANDREW W. MAI, ESQUIRE, FISHBACK <br />DOMINICK LLP, TO SERVE AS THE CODE ENFORCEMENT SPECIAL <br />MAGISTRATE FOR THE CITY OF CASSELBERRY, PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Casselberry currently provides for code <br />enforcement of its Code of Ordinances in Chapter 2, Article IV, Division 2, Code Enforcement <br />Board; and <br />WHEREAS, Ordinance 13-1400 amended the City of Casselberry Code of Ordinances <br />to create an alternate method of code enforcement and nuisance abatement procedures through a <br />Code Enforcement Special Magistrate, pursuant to Section 162.03(2), Florida Statutes; and <br />WHEREAS, a Letter of Interest for the City of Casselberry Special Magistrate position <br />was advertised, and three (3) proposals were received and reviewed by a selection committee <br />comprised of City staff members, per Section 2-149 of the City of Casselberry Code of Ordinances; <br />and <br />WHEREAS, Andrew W. Mai, Esquire, Fishback Dominick LLP, received the highest <br />rank from the selection committee and was selected to serve as the City's Code Enforcement <br />Special Magistrate at a rate of $275.00/hour, which covers all costs and expenses. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby appoints Andrew <br />W. Mai, Esquire, Fishback Dominick LLP, to serve as the City's Code Enforcement Special <br />Magistrate and authorizes the Mayor to execute an Agreement for Special Magistrate Services, <br />attached as Exhibit A, on behalf of the City Commission. <br />SECTION II. Conflicts. All Resolutions, or parts of Resolutions in conflict with any <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
