WHEREAS, this Ordinance is enacted pursuant to the Florida Municipal Home Rule <br />Powers Act, Chapters 163 and 180, Florida Statutes, and other applicable laws authorizing a <br />municipality to set rates, fees and charges for sewer, reclaimed water and water, including the <br />Florida Impact Fee Act, Section 163.31801, Florida Statutes; and <br />WHEREAS, the City Commission finds that it is in the best interest of the health, safety, <br />and general welfare of the citizens of Casselberry and the sewer, reclaimed water and water <br />customers of the City of Casselberry to amend the sewer, reclaimed water and water rates in <br />accordance with the provisions hereof; and <br />WHEREAS, words with underlined type shall constitute additions to the original text and <br />strike through type shall constitute deletions to the original text, and asterisks (* * *) indicate that <br />text shall remain unchanged from the language existing prior to adoption of this Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br />SECTION I. RECITALS. The above recitals (whereas clauses) are hereby adopted as <br />the legislative and administrative findings of the City Commission. The City Commission finds <br />and determines that there is competent substantial evidence to support the findings and <br />determinations made in this Section. <br />SECTION 2. AMENDMENT OF CHAPTER 86, UTILITIES. That Sections 86-68 <br />and 86-72 of Article II, Sewers; 86-186, 86-188, 86-189 and 86-223 of Article III, Water, of <br />Chapter 86, Utilities; of the City Code of Ordinances, are hereby amended as shown in Attachment <br />"A." <br />SECTION 3. CODIFICATION. It is the intention of the City Commission of the City <br />of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become <br />and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections <br />of this Ordinance may be renumbered or re -lettered to accomplish such intention; that the word, <br />"Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />SECTION 4. CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions in conflict with any provisions of this Ordinance are hereby repealed to the extent of <br />the conflict. <br />SECTION 5. SEVERABILITY. If any Section or portion of a Section of this Ordinance <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION 6. EFFECTIVE DATE. This Ordinance shall become effective October 1, <br />2022, except the revisions to Sections 86-68 and 86-186 which become effective December 1, <br />2022. <br />2 <br />
