Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />February 9, 2022 <br />Page 2 <br />Mr. Chris Bowley, Community Development Director, reviewed a PowerPoint presentation on the City's <br />Local Planning Agency's role in land use matters. The presentation included: <br />1. The Role of the Local Planning Agency (LPA) <br />2. State and Regional Land Use Agencies <br />3. Comprehensive Plan <br />4. Unified Land Development Regulations (ULDR) <br />A general discussion ensued regarding recent and possible annexations into the City, the maximum building <br />heights allowed and the use of concrete versus wood in building construction. <br />Ms. Neysa Borkert, Assistant City Attorney, reviewed a PowerPoint presentation on Government in the <br />Sunshine. Ms. Borkert provided an overview of Government in Sunshine Law and the ethical requirements of the <br />Planning and Zoning Commission. The presentation included: <br />1. Examples of Legislative and Quasi -Judicial items <br />2. Ex Parte Communications <br />3. Open Meetings Law <br />4. Communication between board members <br />5. Voting conflicts <br />6. Public participation at meetings <br />7. Sanctions for violation of Sunshine Law <br />8. Public Records Requests/Penalties for failure to comply <br />9. Code of Ethics — Florida Statute Chapter 112 <br />Ms. Gardner suggested that the Planning and Zoning members create a dedicated email or create a <br />separate folder for City business to avoid any problems if a public record is requested. She said that the City's server <br />has the emails that were sent regarding the agenda packet and there is no need to retain those emails. Ms. Gardner <br />stated that inability to produce the information is not legally acceptable and is a violation. Ms. Gardner suggested <br />that members submit any public information they have at the end of their term on the Commission to the City Clerk's <br />office. <br />In response to the Commission's question, Ms. Borkert stated that it is acceptable for a commissioner to <br />look at a site before the meeting. <br />A general discussion ensued regarding staffs recommendations of approval and denial and the verbiage <br />used for motions. <br />Sixth Item of Business: Public Comments. <br />There were no public comments. <br />
