Planning & Zoning Commission/ Local Planning Agency Minutes February 9, 2022 Page 2 Mr. Chris Bowley, Community Development Director, reviewed a PowerPoint presentation on the City's Local Planning Agency's role in land use matters. The presentation included: 1. The Role of the Local Planning Agency (LPA) 2. State and Regional Land Use Agencies 3. Comprehensive Plan 4. Unified Land Development Regulations (ULDR) A general discussion ensued regarding recent and possible annexations into the City, the maximum building heights allowed and the use of concrete versus wood in building construction. Ms. Neysa Borkert, Assistant City Attorney, reviewed a PowerPoint presentation on Government in the Sunshine. Ms. Borkert provided an overview of Government in Sunshine Law and the ethical requirements of the Planning and Zoning Commission. The presentation included: 1. Examples of Legislative and Quasi -Judicial items 2. Ex Parte Communications 3. Open Meetings Law 4. Communication between board members 5. Voting conflicts 6. Public participation at meetings 7. Sanctions for violation of Sunshine Law 8. Public Records Requests/Penalties for failure to comply 9. Code of Ethics — Florida Statute Chapter 112 Ms. Gardner suggested that the Planning and Zoning members create a dedicated email or create a separate folder for City business to avoid any problems if a public record is requested. She said that the City's server has the emails that were sent regarding the agenda packet and there is no need to retain those emails. Ms. Gardner stated that inability to produce the information is not legally acceptable and is a violation. Ms. Gardner suggested that members submit any public information they have at the end of their term on the Commission to the City Clerk's office. In response to the Commission's question, Ms. Borkert stated that it is acceptable for a commissioner to look at a site before the meeting. A general discussion ensued regarding staffs recommendations of approval and denial and the verbiage used for motions. Sixth Item of Business: Public Comments. There were no public comments.
