The City <br />requests a subsequent hearing date of July 21, 2022 to determine compliance. <br />Jeffrey Peppler, 1164 Park Dr. gave testimony. <br />Discussion. <br />The Special Magistrate made a finding that CE -21-000078, located at 1164 Park Dr., to dismiss the case. <br />CE -22-000176: New Case at 140 Sunnytown Rd. <br />• City Code 2-5.3.b Illegal land use. <br />Officer Andreone gave testimony that the property was reinspected and found to remain in violation on <br />June 16, 2022. The City requested a correction date of July 16, 2022. If no compliance by July 16, 2022 <br />then a fine of $150.00 per day should then be imposed for each day of non-compliance thereafter. The <br />City requests a subsequent hearing date of July 21, 2022 to determine compliance. The Special Magistrate <br />asked if there was anyone present to speak to this case, there were representatives present. <br />Phillipe Lopez, contractor hired by property owner gave testimony. <br />Hugh Hagin, property owner, advised he is trying to get the property fixed, the tenants messed up the <br />house with drugs. Mr. Hagin advised he is trying to have the tenants evicted. <br />The Special Magistrate made a finding that CE -22-000176, located at 140 Sunnytown Rd., was in <br />violation of the City Code Sections as listed on the notice of code violation, based on testimony and <br />evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the <br />violations by 1:00 P.M. July 15, 2022. If there is no compliance by July 15, 2022, then a fine of $150.00 <br />per day will be imposed for each day the property remains in non-compliance. A subsequent hearing will <br />be held on July 18, 2022 (actual hearing date July 21, 2021) to determine if compliance has been <br />achieved. <br />SUBSEQUENT CASES <br />CE -21-001266 Subsequent Case at 985 SR 436 <br />• City Code 3-16.11 Sign maintenance. <br />Officer Andreone advised this case was not in compliance, there have been hold ups with the City <br />reviewing the permit. Officer Andreone continued. <br />Elizabeth Watts, office manager gave testimony. <br />The Special Magistrate tabled case 21-001266 for 60 days, to the September 15, 2022 hearing. <br />CE -21-000431 236 Wilshire Dr. <br />• City Code 3-10.3.a.4 roof maintenance <br />Officer Acevedo advised that case 2 1-00043 1 was not in compliance and fines should be imposed. <br />The Special Magistrate advised that in addition to respondent's and Officer Acevedo's testimony, she also <br />had affidavit of non-compliance from Officer Acevedo, indicating the property was not in compliance. <br />Based upon testimony and the affidavit, it was found that the property located at 236 Wilshire Dr. was not <br />in compliance and fines should be imposed. <br />21Pa} _: <br />
