RESOLUTION 10-2205 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND THE CITY OF WINTER SPRINGS FOR AN EMERGENCY POTABLE WATER INTERCONNECTION SYSTEM; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, in July 2008, the City contracted with CPH Engineers, Inc. to conduct an analysis that would identify areas n close proximity of the City's water distribution system that would be feasible to establish a potable water interconnection with local municipalities in the case of an emergency; and WHEREAS, the analysis identified certain locations near the water distribution systems in Seminole County and the Cities of Maitland and Winter Springs as key areas where potable water interconnections were constru; ted; and WHEREAS, Public Works staff from the Cities of Casselberry and Winter Springs have developed an Interlocal Agreement in ar_ effort to devise a control mechanism to provide potable water supply to each other in the case of an emergency; and WHEREAS, the Interiocal agreement provides a methodology for potable water interconnection, payment processing, repair and maintenance, and other necessary understandings in order to ensure that the highest level of water quality is available to service all customers in the case of an emergency; and WHEREAS, the City agrees to share the annual costs associated with the repair and maintenance of the devices utilized at the point of connection, throughout the lifetime of its existence; and WHEREAS, the agreement is for a term of 15 years, beginning after the date of execution; and WHEREAS, City staff (Casselberry and Winter Springs) and the City Attorneys for each have reviewed the Interlocal usage agreement for potable water interconnection between the City of Casselberry and the City of Winter Springs and finds it sufficient to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Interlocal Agreement between the City of Casselberry and the City of Winter Springs for an Emergency Potable Water Interconnection System (attached as "Attachment A") and authorizes the Mayor to execute said document on behalf of the City. SECTION IL Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resoluton are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or pa --t of this Resolution.
