RESOLUTION 10-2206 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 1 TO THE <br />CONTINUING CONSULTING AGREEMENT FOR PROFESSIONAL WATER <br />AND SEWER UTILITY ENGINEERING SERVICES BETWEEN THE CITY OF <br />CASSELBERRY AND BROWN AND CALDWELL REGARDING WASTEWATER <br />TREATMENT AND BIOSOLIDS PROCCESSING; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City wishes to evaluate, analyze, and document the current processes of <br />wastewater treatment as well as evaluate the way biosolids are disposed; and <br />WHEREAS, in June 2010, the City Commission approved a continuing consulting agreement <br />with Brown and Caldwell for professional water and sewer utility engineering services, via Resolution <br />10-2147; and <br />WHEREAS, Supplemental Agreement No. 1 (for an amount not to exceed $39,678 without prior <br />authorization) provides for the evaluation of the current processes of the City's Water Reclamation <br />Facility and the development of plans for upgrading and improving the plant for incorporation into the <br />City's Capital Improvements Program; and <br />WHEREAS, the scope of work generally consists of data collection, analysis, cost estimation, <br />alternatives, CIP development, simplified modeling, etc. and should last for a duration of approximately <br />150 calendar days after the issuance of a Notice to Proceed; and <br />WHEREAS, City staff have reviewed Supplemental Agreement No. 1 to the continuing <br />consulting services contract with Brown and Caldwell and finds it sufficient to meet the needs of the <br />City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves Supplemental <br />Agreement No. 1 to the Continuing Consulting Agreement for Professional Water and Sewer Utility <br />Engineering Services with Brown and Caldwell (attached as "Attachment A") and authorizes the Mayor to <br />execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
