RESOLUTION 10-2207 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 2 TO THE CONTINUING CONSULTING AGREEMENT FOR PROFESSIONAL WATER AND SEWER UTILITY ENGINEERING SERVICES BETWEEN THE CITY OF CASSELBERRY AND BROWN AND CALDWELL REGARDING THE WASTEWATER MASTER PLAN; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City wishes to develop a master plan that will address aging infrastructure, extend/expand the sanitary sewer customer service area, and analyze the feasibility of rezoning the Sanitary Sewer Collection System; and WHEREAS, in June 2010, the City Commission approved a continuing consulting agreement with Brown and Caldwell for professional water and sewer utility engineering services, via Resolution 10-2147; and WHEREAS, Supplemental Agreement No. 2 (for an amount not to exceed $50,000 without prior authorization) provides for the evaluation of the current wastewater collection system and the development of plans for upgrading and improving the collection system for incorporation into the City's Capital Improvements Program; and WHEREAS, the scope of work generally consists of data collection, analysis, cost estimation, alternatives, CIP development, site visits, data validation, and recommendations and should last for a duration of approximately 150 calendar days after the issuance of a Notice to Proceed; and WHEREAS, City staff have reviewed Supplemental Agreement No. 2 to the continuing consulting services contract with Brown and Caldwell and finds it sufficient to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Supplemental Agreement No. 2 to the Continuing Consulting Agreement for Professional Water and Sewer Utility Engineering Services with Brown and Caldwell (attached as "Attachment A") and authorizes the Mayor to execute said document on behalf of the City. SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
