WHEREAS, it is appropriate to temporarily not issue Business Tax Receipts or accept or consider any <br />permit applications and/or the processing of site plans, building permits or development orders, for any <br />development that includes cash only pharmacies, family medical practices, and pain management clinics within <br />the City of Casselberry, for a period of one hundred and eighty (180) days to enable the City to accomplish a <br />study and adopt regulations, as appropriate, to protect the health, safety, and welfare of the residents of the <br />City of Casselberry; and <br />WHEREAS, the City Commission is currently holding public hearings on a proposed moratorium <br />ordinance for cash only pharmacies, family medical practices, and pain management clinics; and <br />WHEREAS, the City Commission desires to formally recognize and confirm the aforementioned status <br />of "legislation in progress" to inform the public of potential changes to the City of Casselberry Code of <br />Ordinances regarding cash only pharmacies, family medical practices, and pain management clinics. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA: <br />SECTION 1: LEGISLATIVE FINDINGS <br />The "Whereas" clauses recited above are true and correct and stand as the legislative findings of <br />the City Commission. <br />SECTION 2. RECOGNIZING LEGISLATION IN PROGRESS <br />(a) The City Commission of the City of Casselberry hereby recognizes and confirms that legislation is <br />in progress related to cash only pharmacies, family medical practices, and pain management clinics. <br />(b) The City shall not issue Business Tax Receipts for the operation of cash only pharmacies, family <br />medical practices, and pain management clinics. <br />(b) The City shall not review or approve any non—exempt applications for development, building permits, <br />site plans, development orders, or any other land -use activity within the City of Casselberry which would allow <br />or permit the construction of cash only pharmacies, family medical practices, and pain management clinics. <br />(c) Exemptions from this Resolution are the following: <br />1. General maintenance, repairs, and/or health and safety improvements on lawfully existing <br />structures or accessory structures, so long as any such altered structures shall remain within the footprint of the <br />original structure. Maintenance and/or repairs proposed for health and safety purposes shall be certified by a <br />professional engineer registered in the State of Florida as repairs which are necessary to correct structural <br />deficiencies which pose a health and safety hazard and shall be approved by the City's Building Official, <br />2. Interior remodeling and decorating of existing lawfully existing structures or accessory structures. <br />3.
