RESOLUTION 10-2200 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE APPROVAL OF AN AGREEMENT WITH J.R. <br />GEISE OPERATIONS, LLC (JRGO) FOR CONSTRUCTION <br />ADMINISTRATION/ INSPECTION SERVICES RELATING TO SECOND <br />ROUND FUNDING FOR ADDITIONAL WATER QUALITY <br />IMPROVEMENT PROJECTS AS APPROVED BY THE FLORIDA <br />DEPARTMENT OF ENVIRONMENTAL PROTECTION; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, via Resolution 09-2076, the City Commission approved and executed an <br />agreement with FDEP to provide first-round ARRA funding to construct water quality <br />improvement projects throughout the City's water distribution system; and <br />WHEREAS, via Resolution 09-2083, the City Commission approved an agreement with <br />JRGO to provide technical services throughout the duration of the first-round water quality <br />improvement projects which included technical engineering design, initial construction bidding, <br />construction inspection, and monitoring grant/loan compliance; and <br />WHEREAS, via Resolution 10-2187, the City applied for additional grant/loan funding <br />from FDEP (a total of $3,0776,923) to construct additional water quality improvements; and <br />WHEREAS, construction of the second -round water quality improvements (FDEP Project <br /># DW59031) will require professional construction administration/inspection services; and <br />WHEREAS, Public Works staff negotiated with and obtained a cost proposal <br />(Supplemental Agreement No. 2), for an amount not to exceed $350,000 without prior <br />authorization, to provide additional construction administration/inspection services necessary for <br />second -round water quality improvements; and <br />WHEREAS, said services are reimbursable under the FDEP grant/loan agreement; and <br />WHEREAS, City staff have reviewed Supplemental Agreement No. 2 for additional <br />construction administration/inspection services as submitted by JRGO and find it favorable to meet <br />the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Supplemental Agreement No. 2 with JRGO for additional construction administration/inspection <br />services (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf <br />of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION IH. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
