RESOLUTION 10-2200 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE APPROVAL OF AN AGREEMENT WITH J.R. GEISE OPERATIONS, LLC (JRGO) FOR CONSTRUCTION ADMINISTRATION/ INSPECTION SERVICES RELATING TO SECOND ROUND FUNDING FOR ADDITIONAL WATER QUALITY IMPROVEMENT PROJECTS AS APPROVED BY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, via Resolution 09-2076, the City Commission approved and executed an agreement with FDEP to provide first-round ARRA funding to construct water quality improvement projects throughout the City's water distribution system; and WHEREAS, via Resolution 09-2083, the City Commission approved an agreement with JRGO to provide technical services throughout the duration of the first-round water quality improvement projects which included technical engineering design, initial construction bidding, construction inspection, and monitoring grant/loan compliance; and WHEREAS, via Resolution 10-2187, the City applied for additional grant/loan funding from FDEP (a total of $3,0776,923) to construct additional water quality improvements; and WHEREAS, construction of the second -round water quality improvements (FDEP Project # DW59031) will require professional construction administration/inspection services; and WHEREAS, Public Works staff negotiated with and obtained a cost proposal (Supplemental Agreement No. 2), for an amount not to exceed $350,000 without prior authorization, to provide additional construction administration/inspection services necessary for second -round water quality improvements; and WHEREAS, said services are reimbursable under the FDEP grant/loan agreement; and WHEREAS, City staff have reviewed Supplemental Agreement No. 2 for additional construction administration/inspection services as submitted by JRGO and find it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Supplemental Agreement No. 2 with JRGO for additional construction administration/inspection services (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IH. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
