RESOLUTION 10-2201 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF A COOPERATIVE PURCHASE <br />AGREEMENT BETWEEN WILBUR SMITH ASSOCIATES AND THE <br />CITY OF CASSELBERRY FOR CONSTRUCTION ENGINEERING <br />INSPECTION SERVICES RELATED TO THE NORTH WINTER PARK <br />DRIVE PHASE II PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry wishes to continue the realignment of North Winter <br />Park Drive from Seventh Street to Red Bug Lake Road as a part of Phase II of the project area; and <br />WHEREAS, via Resolution 10-2194, the City Commission approved a Local Agency <br />Program agreement with the Florida Department of Transportation (FDOT) for the North Winter <br />Park Drive — Phase II Project, which commits FDOT to reimbursing the City up to $2,194,211.00 <br />of the total construction/Construction Engineering Inspection (CEI) costs of the project; and <br />WHEREAS, in order to release stimulus funding, the City is required to provide <br />professional CEI services throughout the duration of the project; and <br />WHEREAS, due to the urgency of implementing the project utilizing surplus Federal <br />American Reinvestment and Recovery Act (ARRA) Stimulus funds, Public Works staff was <br />advised by FDOT that a "piggy -back" on an existing federally -funded contract for CEI services <br />within the local area would be sufficient to meet the funding program requirements; and <br />WHEREAS, Seminole County recently entered into a competitively bid contractual <br />agreement for CEI services with Wilbur Smith Associates for providing construction <br />administration services for a recent roadway project funded by ARRA stimulus funding; and <br />WHEREAS, Wilbur Smith Associates agreed to provide the City with CEI services for the <br />North Winter Park Drive — Phase 11 Project, for an amount not to exceed $199, 472.90 without <br />prior authorization; based on their contract with Seminole County; and <br />WHEREAS, City staff have reviewed the proposal submitted by Wilbur Smith Associates <br />for CEI services relating to the North Winter Park Drive — Phase 11 Project and find it favorable to <br />meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Cooperative Purchase Agreement between Wilbur Smith Associates and the City of Casselberry <br />for CEI services relating to the North Winter Park Drive — Phase II Project, (attached as "Exhibit <br />A"), and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />
