RESOLUTION 10-2192 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A MAINTENANCE MEMORANDUM OF AGREEMENT <br />BETWEEN THE CITY OF CASSELBERRY AND THE FLORIDA DEPARTMENT <br />OF TRANSPORTATION FOR THE MAINTENANCE OF LANDSCAPING AND <br />INFRASTRUCTURE IMPROVEMENTS AS RELATED TO THE SR 436 AND <br />RED BUG LAKE ROAD FLYOVER PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, for the past three years, the Florida Department of Transportation (FDOT), <br />Seminole County and City staff have worked with the engineering design firm of URS to enhance <br />the project design as related to landscaping/irrigation, hardscaping, decorative fencing, pond <br />aesthetics, textured stamped pavement cross -walks, and a portion of the Wirz Park Trail for the SR <br />436 and Red Bug Lake Road Flyover Project; and <br />WHEREAS, per an existing Memorandum of Agreement (MOA) with FDOT, the City <br />already provides maintenance activities within the right of way of this segment of the SR 436 <br />corridor; and <br />WHEREAS, the new Maintenance MOA formally commits the City to providing <br />maintenance of the new infrastructure improvements, if and when maintenance activities are <br />required; and <br />WHEREAS, City staff have reviewed the Maintenance MOA as submitted by FDOT <br />relating to the SR 436 and Red Bug Lake Road Flyover Project and find it acceptable to meet the <br />needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Maintenance Memorandum of Agreement between the City of Casselberry and the Florida <br />Department of Transportation relating to the SR 436 and Red Bug Lake Road Flyover Project, <br />attached hereto as Attachment `A', and -authorizes the Mayor to execute said document on behalf of <br />the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
