WHEREAS, the parties hereto have determined that this Agreement is in furtherance of the community health, safety and welfare and the public interest, NOW THEREFORE, in consideration of the premises herein, the parties hereby agree as follows: Section 1. Recitals. The above recitals are true and correct and form a material part of this Agreement upon which the parties have relied. Section 2. Purpose. The purpose of this Agreement is for the COUNTY to assign and transfer to the CITY ownership, jurisdiction over and full functional responsibility for that portion of Belle Avenue lying between the north line of Lot 1, Swop Subdivision (Plat Book 39, Page 63) south to the southerly line of Johnson's Poultry Farms also being the same as the south line of Lot 108, D.R. Mitchell's Survey of the Levy Grant (Plat Book 1, Page 5), all as shown on the attached Attachment "A", incorporated herein by reference. Section 3. Transfer of Responsibility. Within 14 days of the date this Agreement is approved and fully executed by both parties (the "effective date"), the COUNTY shall deliver a deed in accordance with Section 125.411, Florida Statutes, conveying its interest in that portion of Belle Avenue described in Section 2 to the CITY. The CITY shall be responsible for the cost of recording the deed and this Agreement in the Public Records of Seminole County, Florida. Upon conveyance, the CITY shall have ownership of, plenary authority over and full responsibility for the functional operation and maintenance of the roads specified in Section 2 'above.
