RESOLUTION 08-1867 8 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF AN INTERLOCAL AGREEMENT BETWEEN SEMINOLE COUNTY <br />AND THE CITY OF CASSELBERRY FOR THE TRANSFER OF OWNERSHIP OF <br />BELLE AVENUE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE." <br />WHEREAS, the City of Casselberry vacated the southern portion of Belle Avenue in <br />anticipation of the North Winter Park Drive Realignment Project; and <br />WHEREAS, it was determined that a jurisdictional transfer from Seminole County is <br />necessary; and <br />WHEREAS, Seminole County has submitted an Interlocal Agreement transferring the <br />ownership, maintenance, and functional responsibility of this roadway to the City; and <br />WHEREAS, City staff has reviewed the Agreement submitted by Seminole County and <br />find it to be favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission of the City of Casselberry hereby approves the <br />Interlocal Agreement between Seminole County and the City of Casselberry (attached as "Exhibit <br />A"), and authorizes the Mayor to execute the said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date.
