BASED ON THE 2009 CONSUMER PRICE INDEX (CPI); PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, via Ordinance 10-1311, the City entered into a cooperative purchase agreement for solid waste collection services with Waste Pro based on a competitively bid agreement between Waste Pro and Seminole County; and WHEREAS, said agreement includes a CPI rate adjustment matrix that provides for annual consideration of inflation due to labor, equipment, and material costs as well as consideration for fuel; and WHEREAS, Seminole County agreed to calculate and provide the City with annual CPI data provided by the U.S. Department of Labor, Bureau of Labor Statistics and the U.S. Energy Information Administration; and WHEREAS, the new base rate for solid waste collection will be increased from $11.92 per home per month to $12.06 per home per month for regular and special collection services and $22.06 per home per month for side door collection services for customers without a medical debilitating condition; and WHEREAS, the City has accumulated a surplus of funds resulting from the difference between what the City charged for disposal during October 2009 through April 2010 and the actual costs to the City; and WHEREAS, it is recommended that this surplus absorb the total costs associated with the 2009 CPI rate adjustment ($8,464.50) in lieu of passing the rate increase on to residents; and WHEREAS, the new rates will become effective October 1, 2010; and WHEREAS, Public Works staff has reviewed the 2009 CPI data submitted by Seminole County and recommend a rate adjustment accordingly. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves a rate adjustment payable to Waste Pro for residential solid waste collection effective October I, 2010, increasing the base rate from $11.92 per home per month to $12.06 per home per month for regular and special residential solid waste collection and from $21.92 per home per month to $22.06 per home per month for side door collection services for residents without a debilitating medical condition, based on data received from the 2009 CPI (attached as "Exhibit A — Table 1"
