RESOLUTION 10-2109 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA APPROVING AND AUTHORIZING ENTERING INTO A LICENSE AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND STERLING PARK HOUSING ASSOCIATION, INC. FOR WIRZ TRAIL SECTION II, PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, trail systems are a valuable asset to the vibrancy of a community providing outlets and opportunities for both recreation and transportation; and WHEREAS, trail systems provide an economic benefit to cities and neighborhoods where trails exist and are a significant element of the City of Casselberry's Comprehensive Plan; and WHEREAS, the City of Casselberry has completed the construction of Wirz Trail Section II, and a portion of the trail traverves on land owned by Sterling Park Housing Association, Inc. in Seminole County; and WHEREAS, the City desires to enter into a License Agreement with Sterling Park Housing Association, Inc. in order to operate and maintain the portions of Wirz Trail Section II that traverses on land owned by Sterling Park Housing Association, Inc. in Seminole County. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the License Agreement with Sterling Park Housing Association, Inc. (attached as Exhibit "A") and authorizes the Mayor to execute said document on behalf of the City SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
