RESOLUTION 10-2113 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXTENSIONS (SPR 09-14) OF SITE PLAN (SPR 07-16) AND PRELIMINARY PLAT (SP 07-07) DEVELOPMENT APPROVALS FOR THE LEGACY PARK PHASE 3 RESIDENTIAL DEVELOPMENT LOCATED WITHIN THE LEGACY PARK PLANNED DEVELOPMENT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Casselberry provided site plan (SPR 07-16) approval for the Legacy Park Phase 3 residential development located within the Legacy Park Planned Development on December 10, 2007, expiring December 10, 2008; and WHEREAS, the City Commission of the City of Casselberry provided preliminary plat (SP 07- 07) approval for the Legacy Park Phase 3 residential development located within the Legacy Park Planned Development on April 14, 2008, expiring October 14, 2009; and WHEREAS, automatic two-year extensions allowed by State legislation per Senate Bill 360 were considered but the legislation is now currently being challenged; and WHEREAS, the City's Unified Land Development Regulations provide an opportunity for a one-year site plan extension per Section 4-18.5; and WHEREAS, the Unified Land Development Regulations provide an opportunity for an eighteen -month preliminary plat extension per Section 4-19.10. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves the one-year extension (SPR 09-14) for the Legacy Park Phase 3 residential development site plan (SPR 07-16) located within the Legacy Park Planned Development. Such extension of the site plan approval shall expire on December 10, 2010. This action is based on the original conditions of approval for SPR 07- 16 provided on December 10, 2007. SECTION 2. The City Commission of the City of Casselberry hereby approves the eighteen - month extension (SPR 09-14) for the Legacy Park Phase 3 preliminary plat (SP 07-07) for the property located within the Legacy Park Planned Development. Such extension of the preliminary plat approval shall expire on April 14, 2011. This action is based on the original conditions of approval for SP 07-07 provided on April 14, 2008. SECTION 3. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
